The EB-2 employment-based second preference visa is available to applicants with an advanced degree who are seeking to work in a position that requires that degree or to individuals showing exceptional ability in the sciences, arts or business.

Obtaining an EB-2 requires that the applicant have an approved labor certification unless they can obtain a National Interest Waiver.

Advanced Degree

In order to be eligible for an EB-2 visa under the advanced degree classification, the job you apply for must require an advanced degree and the applicant must possess either that degree or its equivalent. A bachelor's degree with 5+ years of progressive work experience may be sufficient.

Evidence of an Advanced Degree

  • Official academic record showing proof of U.S. advanced degree or foreign equivalent
  • Official academic record showing proof of U.S. bachelor degree or foreign equivalent
    • Letters from current and former employers showing proof of 5+ years of progressive work experience in the field

Exceptional Ability

An applicant seeking permanent status under the EB-2 exceptional ability classification is required to show exceptional ability in the sciences, arts or business. Exceptional ability is defined as a "degree of expertise significantly above that ordinarily encountered in the sciences, arts, or business.”

Proving Exceptional Ability

Applicants must meet at least three of the following criteria:

  • Received a degree, diploma, certificate or similar award from a college, university, school or other institution related to the field of exceptional ability
  • Have at least 10 years of full-time experience in the field
  • If required, have a license or certification to practice in the field
  • Will receive a salary commensurate with your experience and exceptional ability
  • Member of professional associations
  • Recognition of achievements and contributions by peers in the field
